Who these terms are with

explayn is operated by Alex Neil, trading as explayn, 57 Goldstone Road, Hove, BN3 3RG. Using the service means accepting these terms. If you do not accept them, please do not use it.

These terms are between us and the account holder — a teacher, or a school taking seats for its teachers. Students play without an account and are not party to them.

Accounts

You must be 18 or over to hold an account. Keep your password to yourself; you are responsible for what happens under your account.

One person per account. Sharing a login rather than taking a school seat is not permitted, mostly because it makes a mess of whose sets are whose.

Your sets and words

The word sets you create are yours. We claim no ownership of them and we do not use them for anything other than running the service for you.

You are responsible for what you put in them. Do not upload anything unlawful, hateful, or that infringes someone else's rights — bearing in mind that a set is shown to a classroom.

We can remove content that breaks these terms, and will tell you why if we do.

Codes and access

A set is reachable only while you have put it up. Putting a set up creates a new six-digit code, and taking it down retires that code immediately.

Codes are short so they can be read aloud to a class. That also means they are guessable, so treat a code as a convenience rather than a security measure, and do not put anything confidential into a set.

Using the service sensibly

Please do not:

• Try to reach sets that are not yours, including by guessing codes.
• Automate requests, scrape the service, or work around its rate limits.
• Resell access, or present the service as your own.
• Try to break, overload or find holes in it — though if you find one, please tell us.

Free and paid plans

The free plan is genuinely free and has no time limit. A subscription lifts the limits on how much you can build; it does not change anything for your students, who always play free.

Prices are shown before you pay and include VAT where it applies. We may change prices, but not for a period you have already paid for, and we will tell existing subscribers before a renewal at a new price.

Billing and renewal

Subscriptions renew automatically at the end of each period until cancelled. Payment is taken by Stripe using the card you gave at checkout.

If a payment fails, Stripe retries it over several days. Your plan stays active during that time so a failed card does not interrupt a lesson. If it keeps failing, the subscription ends and the account returns to the free plan.

Nothing you have made is deleted when a subscription ends. Sets beyond the free limit become read-only rather than disappearing, and sets that were staying up will need putting up per lesson again.

Cancelling and refunds

Cancel at any time from the plan page, which opens Stripe's billing portal. Access continues to the end of the period you have paid for; there is no cancellation fee.

If you change your mind within 14 days of first subscribing, email alex@ajneil.co.uk and we will refund you in full, no questions asked.

This does not affect your statutory rights as a consumer.

School accounts

A school buys a seat for each teacher. The organiser manages the roster and the subscription, and is the person we bill and contact.

Teachers join with the school's code. Removing a teacher frees their seat immediately and returns them to the free plan; their own sets stay theirs and are not transferred to the school.

If the seat count is reduced below the number of teachers on the roster, the roster is trimmed to fit. The organiser is never removed.

Availability

We try to keep the service running and working well, but we cannot promise it will never be unavailable. It is provided as it is, without warranties beyond those the law requires.

Have a fallback for a lesson that depends on it. Wifi in schools being what it is, that is good advice regardless of who built the software.

Liability

We do not limit our liability for death or personal injury caused by negligence, for fraud, or for anything else the law does not allow us to limit.

Otherwise, and to the extent the law permits, our total liability to you is limited to what you have paid us in the twelve months before the claim. We are not liable for indirect or consequential loss, or for lost teaching time.

Ending the arrangement

You can close your account whenever you like by writing to us; we will delete your data as set out in the privacy policy.

We may suspend or close an account that breaks these terms. Unless the breach is serious, we will warn you first and give you a chance to put it right. If we close a paid account for a reason that is not your fault, we will refund the unused part.

Changes to these terms

We may update these terms. The date at the top shows when they last changed, and we will email account holders about anything material rather than change them quietly.

Law

These terms are governed by the law of England and Wales, and its courts have jurisdiction. If you are a consumer elsewhere, you keep the protections of your own country's law.
